If you are a buyer purchasing a flat with a short lease, provided the seller has owned the flat for 2 years, he can commence a statutory lease extension by serving a section 42 notice of claim and assigning the benefit of that notice to you on completion of your purchase of the flat. You then take over the lease extension even though you have not owned the flat for 2 years.
The same applies if you are a leaseholder selling a flat with a short lease. Your buyer may ask you to serve a section 42 notice of claim and assign the benefit of that notice to them on completion of the sale of the flat.
